Also in many states (several states with their own OSHA) government employees, which includes public universities and colleges, are not exe mpt from OSHA regulations. Tenure is not an excuse for not firing an in dividual who ignores safety and training. A new professor, graduate stu dent, post-doc, and undergraduate student should be informed during inte rviews and/or on their first day that safety is first and they will be t erminated for failure to abide by attending and enforcing safety. Look what's happening in California. I agree with Ms. Damon except every industry I have worked in it was thr ee strikes you're out (first - written warning, second - three day suspe nsion no pay, third - don't let the door hit you) with the caveat that d ismissal can occur on the first violation/offense if the action endanger ed or could have endangered people of equipment. I have a close friend who worked for OSHA in the "complaint department" who said 95+% of compl aints about dismissal for violation of safety were found in favor of the employer.
